Disclosures & Risk Disclosure.

Everything qMachina publishes is impersonal, broadcast information for general circulation — not individualized investment, trading, legal, or tax advice. All performance shown anywhere on this site, in our alerts, posts, dashboard, or any other channel is SIMULATED (paper/shadow run), not a record of actual trading. Read all of the disclosures below before relying on anything we publish.

1. CFTC Rule 4.41(b) — Hypothetical Performance Disclaimer

CFTC RULE 4.41 — HYPOTHETICAL PERFORMANCE RESULTS

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.

Every backtest, walk-forward study, paper-trading figure, and shadow-run statistic published by qMachina — including all win rates, tick/point counts, per-family results, dispersion bands, MFE/MAE figures, and any number shown on the Methodology, Dashboard, Track Record, or Falsified pages — is SIMULATED or SIMULATED performance and is subject to the limitations stated above. Our published track record is a paper/shadow record of signals; it is not a live-fill record and does not represent that any account traded these signals or achieved these results. Performance remains hypothetical until and unless qMachina publishes a verified live-fill record, which it has not done.

2. Futures Trading Risk Disclosure

SUBSTANTIAL RISK OF LOSS — FUTURES

Trading futures and futures options involves a substantial risk of loss and is not suitable for all investors. You should carefully consider whether trading is appropriate for you in light of your circumstances, knowledge, and financial resources. You may lose all or more than your initial investment. Because futures are leveraged, a relatively small market movement will have a proportionately larger impact on the funds you have deposited; you may sustain a total loss of your funds and may be required to deposit additional funds to maintain your position.

Past performance is not necessarily indicative of future results. Past or hypothetical performance is not a guarantee of, and is not indicative of, future results. No representation is being made that any account is likely to achieve profits or losses similar to those discussed.

This brief statement cannot disclose all the risks and other significant aspects of trading futures and options. You should therefore carefully study futures and options trading, and obtain the official risk-disclosure documents required by your broker and by applicable rules (including the CFTC/NFA risk disclosure statement), before you trade. Only risk capital — money you can afford to lose without affecting your lifestyle or financial security — should ever be used for trading.

3. Options Trading Risk Disclosure

OPTIONS — SUBSTANTIAL OR TOTAL LOSS OF PREMIUM

Options trading carries a high level of risk and is not suitable for all investors. The purchaser of an option may lose the entire premium paid. Short-dated and zero-days-to-expiration (0DTE) options are especially hazardous: their value can decay or move adversely extremely quickly, and a 0DTE position can lose its entire premium within minutes, or expire worthless. Sellers (writers) of options can face unlimited or substantially larger losses than the premium received. Because of leverage, time decay, gap risk, and rapid changes in implied volatility, options positions can move against you faster than you can react or exit.

Before trading options you should read the standardized options risk-disclosure document, Characteristics and Risks of Standardized Options, available from your broker, and understand the specific contract specifications and expiration mechanics. Any options-related content qMachina publishes is impersonal, general, and hypothetical, and is not a recommendation to enter any specific options position.

4. Impersonal Publication — Not Individualized Advice; Not Registered

IMPERSONAL, BROADCAST INFORMATION ONLY

qMachina is a bona fide publisher of impersonal, broadcast market information of general and regular circulation. The signals, levels, regime states, dashboards, and commentary we distribute are identical for all subscribers and are not tailored to any individual's account size, positions, holdings, risk tolerance, objectives, financial situation, or particular needs.

Nothing qMachina publishes is, or should be construed as, individualized investment, trading, legal, or tax advice, a recommendation, a solicitation, or an offer to buy or sell any security, futures contract, option, or other instrument. We do not advise you on what you should do.

qMachina is not registered with the U.S. Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA), or the U.S. Securities and Exchange Commission (SEC) as a commodity trading advisor (CTA), commodity pool operator (CPO), broker-dealer, futures commission merchant, or investment adviser, and does not hold itself out as any of these. qMachina does not direct, manage, access, or trade any customer account, does not exercise discretion over any account, does not handle customer funds, does not pool money, and does not auto-execute or control execution of any trade for any subscriber. You alone decide whether, when, what, and how much to trade, and you alone place and manage your own orders through your own broker.

If you require advice tailored to your situation, consult a licensed and registered investment, financial, legal, or tax professional.

5. No Guarantee · Results Vary · Sole Responsibility

NO GUARANTEE OF RESULTS

qMachina makes no guarantee, representation, or warranty of any kind that any signal, level, gate state, method, or piece of information will be profitable, accurate, complete, timely, error-free, or suitable for any purpose. There is no guarantee of any specific outcome or profit, and no representation that any account will or is likely to achieve results similar to any shown.

Individual results will vary and may differ materially from any hypothetical, simulated, or other results presented, because of differences in timing, execution, fills, slippage, fees, commissions, latency, available liquidity, position sizing, discretionary decisions, market conditions, and other factors entirely outside qMachina's control.

You are solely responsible for your own trading and investment decisions, for your own risk management, and for any resulting profits or losses. By using qMachina you acknowledge that you trade at your own risk and that, to the fullest extent permitted by law, qMachina and its operators, owners, and affiliates are not liable for any losses, damages, or costs arising from your use of, or reliance on, anything we publish.

6. Data, Latency & Simulation Limitations

SIMULATED / SIMULATED MODELS · DELIVERY MAY BE DELAYED OR INTERRUPTED

qMachina's signals, statistics, gates, and dashboards are derived from simulated and hypothetical models applied to historical and recorded market data and to a paper/shadow runner — not from live executed trades. Modeled fills, prices, and results are estimates produced with the benefit of recorded data and do not represent prices or fills you would actually obtain in a live market.

Market data may contain errors, gaps, or revisions, and may be delayed relative to the live market. Signal and alert delivery may be delayed, interrupted, throttled, out of order, or unavailable due to data feeds, computation time, network conditions, third-party platforms (e.g. Discord, X, email, TradingView), latency, downtime, or other factors. A signal you receive may already be stale; the actual market price may have moved before you can act, and you may be unable to obtain the indicated entry, exit, or level. qMachina does not guarantee the availability, timeliness, sequencing, or delivery of any signal or alert.

Hypothetical and simulated results are designed with the benefit of hindsight, may not account for all real-world frictions, and do not represent actual trading. Do not assume that live results will match any modeled, hypothetical, or simulated figure.

7. General

These disclosures apply to the entire qMachina website and to every channel through which qMachina distributes information, including but not limited to the website, the Dashboard, the hash-chained Track Record, alerts and digests delivered via Discord, posts on X, email, any API or data feed, and the TradingView "qMachina Levels" and "qMachina Signals" indicators. By accessing or using any qMachina content or channel, you acknowledge that you have read, understood, and agree to these disclosures in full.

Nothing on this page or anywhere on this site is legal, tax, accounting, or financial advice. qMachina reserves the right to update these disclosures at any time; the current version governs your use.
